New Hampshire DUI Laws & Penalties

While the legal blood alcohol limit to drive in New Hampshire is pretty standard with laws across the country, the penalties associated with violating that law in this state are very strict. The penalties an individual may face will vary by the number of previous offenses that person may have on their record.

See the list below for further details on possible penalties:


  • 1st Offense - a fine between $500-$1,200, and license suspension for 6 months
  • 2nd Offense - a minimum of 30 days in jail, a fine of at least $750, license suspension for 3 years, and an Ignition Interlock Device (IID) may be required
  • 3rd Offense - a minimum of 180 days in jail, a fine of at least $750, and indefinite license suspension
